Terms of Use
These Terms of Use ("Terms") govern your use of the Apex Motion app on iPhone and Android and of the apexmotion.app website (together, the "Service"), provided by Apex Motion LLC ("Apex Motion", "we", "us"). By downloading or using the Service you agree to these Terms. If you don't agree, don't use the Service. Our Privacy Policy explains how we handle your data, and is part of these Terms.
If you got the app from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies. If it and these Terms conflict about your licence to use the app, Apple's agreement governs.
1. What Apex Motion is, and isn't
Apex Motion is a basketball training tool. It measures your shooting mechanics from video you record, gives you coaching feedback, and suggests drills. It is not medical advice, physical therapy, or a substitute for a qualified coach, trainer or healthcare professional.
2. Training at your own risk
Basketball training is physical, and physical activity carries a risk of injury. When you do any drill, exercise or shooting session the Service suggests or scores:
- you take part voluntarily and accept the risk of injury, including sprains, strains, and joint and muscle injuries;
- you are responsible for training within your own limits, on a safe surface and with suitable equipment, and for stopping at once if you feel pain, dizziness or discomfort; and
- to the extent the law allows, we are not liable for any injury or loss you suffer while doing those activities.
Nothing in these Terms limits liability that the law does not allow to be limited.
3. Who can use the Service, and accounts
- You must be at least 13 years old to use the Service, or 16 in the European Union and the European Economic Area.
- You can run your first assessment without an account. Creating an account needs a valid email address and passes a neutral age check.
- You are responsible for keeping your account secure and for activity under it. Sign-in and password-reset links are for your use only.
- Please give accurate information, and keep it up to date.
4. Your free assessment and Premium
- Free: each account gets one free shot assessment, or each device while you aren't signed in. We may change the free allowance for new users.
- Premium is an auto-renewing subscription, monthly or annual. It includes two shot assessments in each seven-day cycle, counted from the date you subscribed, together with training programs and Live Training. The price, and any free trial, is shown in the store before you buy.
- Billing: you buy Premium through the store you got the app from: Apple's App Store on iPhone, or Google Play on Android. That store charges you, and we never see your card or bank details.
- Renewal and cancelling: a subscription renews automatically until you cancel it. Cancel in your App Store account settings (at least 24 hours before the end of the current period) or in Google Play's Subscriptions page (before the renewal date). Cancelling stops the next renewal; Premium continues until the end of the period you paid for. Deleting the app or your account does not cancel a subscription.
- Refunds are handled by Apple or Google under their own refund policies; we can't issue store refunds ourselves.
5. AI coaching
The written coaching in your reports is produced by a large language model run by our AI provider, from your shot measurements, with your permission (see Section 6 of our Privacy Policy). AI-written coaching can be incomplete or wrong. Treat it as a training suggestion, use your own judgement, and don't rely on it as professional, medical or safety advice.
6. Your videos and content
You keep all rights to the videos you record. You let us process each video only to produce the analysis you asked for. Videos are deleted from our servers as soon as the analysis finishes; the motion data and results we keep are described in our Privacy Policy, as is your choice about whether we may learn from your stored analyses.
You are responsible for what you record. Record only yourself, or people who have agreed to be recorded, and follow local law and the rules of the place you train.
7. Analysis results
Scores, measurements and comparisons are estimates made by computer-vision models. They have margins of error and are for training and information only. We don't promise any level of accuracy, improvement or athletic result. The pro benchmark the app compares you with is a statistical reference; no athlete endorses Apex Motion.
8. Your licence to use the Service
We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own training. You may not copy, modify, distribute, sell, lease, reverse-engineer or extract the Service's models, scoring or data, except where the law does not allow that restriction.
9. Acceptable use
You agree not to: (a) use the Service for anything unlawful; (b) probe, disrupt or overload our systems; (c) try to access other people's data; (d) scrape the Service or access it by automated means; (e) misstate your age or identity, including to get past the age check; or (f) resell the Service's analysis as your own service.
10. Intellectual property
The Service, including the Apex Motion name, logo, app design, scoring method and the way results are presented, belongs to us or our licensors and is protected by intellectual-property law.
11. Ending your use
You can stop using the Service at any time, and delete your account in the app. We may suspend or end access that breaks these Terms or threatens the Service or other users. Sections 2, 7, 12 and 13 continue to apply after your use ends.
12. Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free.
13. Limitation of liability
To the extent the law allows, our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid for the Service in the twelve months before the claim arose, or (b) USD 50. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits or lost data. Consumer rights that the law of your country gives you, and that can't be excluded, are not affected.
14. Governing law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. If you are a consumer, the mandatory consumer-protection law of the country where you live still applies.
15. Changes to these Terms
We may update these Terms. We'll change the "Last updated" date above, and tell you in the app or by email about material changes. Continuing to use the Service after a change takes effect means you accept it.
